The Evidentiary Crisis of the Digital Age: AI-Generated Deepfakes and the Fragility of Judicial Truth-Finding

The emergence of AI-generated deepfakes represents a fundamental disruption to the evidentiary foundations of modern criminal justice systems. This article examines how synthetic media technologies capable of producing hyper-realistic audio and video content indistinguishable from authentic recordings undermine long-standing assumptions about the reliability of audiovisual evidence. Drawing on criminological theory, comparative legal analysis, and empirical case studies, the article argues that deepfakes precipitate an evidentiary crisis that transcends traditional concerns about evidence tampering. Unlike conventional forms of manipulation that leave detectable traces, deepfakes can be generated as entirely synthetic artifacts with no corresponding real-world event, collapsing the evidentiary framework built on the premise that falsification occurs subsequent to an authentic original. The article analyzes the "liar's dividend" phenomenon, whereby the mere existence of deepfake technology enables plausible denial of authentic evidence, and examines how this dynamic complicates investigations, prosecutions, and judicial decision-making. It further considers the disproportionate impact on developing jurisdictions with limited forensic capacity, using Pakistan as a case study to illustrate the institutional and doctrinal vulnerabilities that exacerbate the evidentiary challenges posed by synthetic media. The article concludes by advocating for heightened authentication standards, specialized judicial training, and the development of forensic protocols capable of restoring confidence in digital evidence without compromising due process protections.
